  1. What if you're born right on the border?
    I believe if the mother is an American citizen, her citizenship extends to the child being born. If the mother is not an American citizen, her nationality extends to the child even if born in the United States.
    Imagine if a sweed had a baby in Mexico, is the child now a Mexican citizen? I don't think so.
    Can people be citizens in two different countries at the same time? Can people be legal residents in two different states? If so, you would run into different laws between the states that apply to that person. Who would have jurisdiction? It all becomes complex.
    We need to apply the KISS theory—-keep it simple stupid.

  2. Persons and people are not defined the same in law. So why is it that all persons, not all people, are subject to the jurisdiction thereof? Persons and people can be the same, but some persons are not people. Because a judge rules a certain way, does not mean their ruling is correct. It is only an opinion, based on their interpretation of the law. So be afraid of the judges, because they can interpret the law any way they wish. No law states people must pay taxes, but don't tell that to a judge… even you admit the system is corrupt.

  4. It is of great importance to read the papers and arguments while writing this amendment for a fully comprehensive understanding. For the CONTEXT. Anchor babies are NOT citizens.

  5. illegals have no rights to birthrights if they entered the US illegally that's just logic. If a American goes to Canada illegally and has a kid that kid does not have birthrights and they wont allow you give that child Canadian citizenship.

  6. There should be NO confusion on that point. Two words, born or naturalized, speak volumes or should. Subject to the jurisdiction of the United States. Foreign,aliens etal another part that takes precedence. Oath of Allegiance must be done if being naturalized. Simplified, 2 foreign parents, giving birth to a child, having no allegiance to the US, are subject to the country to where they come from. Therefor, so is the child. It cannot be considered a citizen. Period. Look up Justice William Brennan and his footnote, that opened up the floodgates.

  7. A little history on the subject. To say that Vattel's "Law of Nations" didn't play a major part in the understanding of the founding fathers is intellectual dishonesty, for that reason I'll show you three historical documents.

    1) Benjamin Franklin to: Charles William Frederic Dumas

    I received your several favors, of May 18th, June 30th, and July 8th, by Messrs. Vaillant

    and Pochard;(1) whom if I could serve upon your recommendation, it would give me

    employment among us; but I hope they will soon obtain some knowledge of it. This is a

    good country for artificers or farmers; but gentlemen of mere science in les belles lettres

    cannot so easily subsist here, there being little demand for their assistance among an

    industrious people, who, as yet, have not much leisure for studies of that kind.

    I am much obliged by the kind present you have made us of your edition of Vattel. It

    came to us in good season, when the circumstances of a rising state make it necessary

    frequently to consult the law of nations.

    Accordingly that copy, which I kept, (after

    depositing one in our own public library here, and sending the other to the College of

    Massachusetts Bay, as you directed,) has been continually in the hands of the members of

    our Congress, now sitting, who are much pleased with your notes and preface, and have

    entertained a high and just esteem for their author. Your manuscript "Idee sur le

    Gouvernement et la Royaute" is also well relished, and may, in time, have its effect. I

    thank you, likewise, for the other smaller pieces, which accompanied Vattel. "Le court

    Expose de ce qui s'est passe entre la Cour Britannique et les Colonies," bc. being a very

    concise and clear statement of facts, will be reprinted here for the use of our new friends

    in Canada. The translations of the proceedings of our Congress are very acceptable. I

    send you herewith what of them has been farther published here, together with a few

    newspapers, containing accounts of some of the successes Providence has favored us

    with. We are threatened from England with a very powerful force, to come next year

    against us.(2) We are making all the provision in our power here to oppose that force, and

    we hope we shall be able to defend ourselves. But, as the events of war are always

    uncertain, possibly, after another campaign, we may find it necessary to ask the aid of

    some foreign power.

    2) Minor v. Happersett 88 U.S. 162 (Decided: March 29, 1875) @ paragraph 9:

    " The Constitution does not, in words, say who shall be natural-born citizens. RESORT MUST BE HAD ELSEWHERE TO ASCERTAIN THAT (emphasis added). At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their [p168] parents. As to this class there have been doubts, but never as to the first. For the purposes of this case it is not necessary to solve these doubts. It is sufficient for everything we have now to consider that all children born of citizen parents within the jurisdiction are themselves citizens. The words "all children" are certainly as comprehensive, when used in this connection, as "all persons," and if females are included in the last they must be in the first. That they are included in the last is not denied. In fact the whole argument of the plaintiffs proceeds upon that idea.".

    That elsewhere for SCOTUS was "The Law of Nations" as follows in 3.

    3) The Law of Nations (Vattel) , Book 1, Chapter XIX @ 212 :

    "The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country."

    One more time as to how the founders saw citizenship ". I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country."

  10. Howdy Lionel. A little off topic but you mentioned, briefly, the 16th amendment; that said the govt can put a direct tax without apportionment. Only a few years after the fed reserve was created. But my question is, is there a law that states I must/ shall fill out a tax return. And by doing so am I self incriminating myself by filing one; whether I'm honest, lying, or unaware of with by doing so.

  26. Totally disagree…this Amendment was written for the children of slaves. If you read the congressional record when presented it is CLEAR, that it was for the children of slaves ONLY!

  27. Letter of the law vs. spirit of the law. The author of this amendment stated the intention of this amendment and stated specifically that this was not its intent. The Author of this amendment was a Senator from Michigan.

  30. If your parents are foreign dignitaries then sorry you are not a US citizen just because you were born in the US. However if your parents were merely foreign and not dignitaries you are a US citizen ? Makes no sense, never did and never will. This current " birthright citizenship" was merely an unsupported/unchallenged change in the interpretation of the law by the executive branch to facilitate immigration. Therefore the chief executive may merely direct a reversion to the previous correct interpretation by executive order.

  31. Citizenship of a country should be granted to all persons born in a country where both parents are citizens. Children of non-citizen parents are not normally automatically qualified for citizenship. Children born to a citizen mother and a non-Citizen father persons in the US who meet the current regulations for naturalization and have been naturalized, should be regarded as it both parents were citizens by right. So where is the problem?

  36. Lionel, you buried the lede by leaving it until the absolute end to mention the president's enforcement authority — which authority is linked to his duty to see that the laws are faithfully executed.

    To me, your attempt to counterbalance Congress' textual commitment to immigration matters against the presidential enforcement authority makes at least 2 implicit assumptions that are invalid: 1) you assume that somehow Congress HAS TO ACT on every immigration matter, and 2) you assume that the president CANNOT ACT where Congress has not acted.

    But upon reflection, don't you have to concede: 1) that Congress in fact simply does not always act and 2) that the president cannot be expected to defer his own action involving constitutional enforcement unless and until Congress acts?

    As a separate political branch of government the president can reach a reasoned interpretation of the Constitution, especially in a legislative vacuum created by Congress' inaction.

    And the president doesn't have the luxury of getting advisory opinions or of certifying questions to SCOTUS.

    In these circumstances the president has to act — and if his action by way of a reasonable interpretation in an executive order generates specific cases or controversies, well then that's how it's supposed to work under the Constitution and we take it from there.
